Terms of Service and Rental Agreement

Rental Agreement

This agreement is between Sitting Pretty Potties LLC (hereafter known as Company) and the customer (Customer).

  • Company agrees to furnish the equipment for rental to customer to be delivered and placed on level ground at agreed upon address.
  • Delivery and pickup dates and times are outlined in the quote and will be finalized prior to the date of delivery.
  • All equipment subject to availability at time of contract signing.
  • Customer expressly agrees to defend, indemnify and hold harmless the Company from any and all damage to property or injury to persons suffered in or with respect to the Unit(s) during Customer's use, possession or operation of the Unit(s), whether resulting from negligence, lack of care, abuse or ordinary use. This indemnity shall extend to damage, injury, losses, claims, suits, judgments or actions arising from the negligence of Customer, guests, agents, invitees or anyone Customer controls or employs, or who is near or in the Unit(s) or for damage or injury resulting from the use of the Unit(s) or entry or egress into or from such Unit(s).
  • Once the Unit(s) is (are) delivered, Customer is responsible for keeping the Unit(s) safe from theft or vandalism or any other damage, including any damage or vandalism caused by the Customer's guests, attendees, or invitees.
  • Customer is responsible for ensuring that the Unit(s) are in good working order after the rental period.
  • The Unit(s) should not be trashed or excessively dirty. Trashed or excessively dirty Unit(s) will incur an extra cleaning fee.
  • Customer agrees to pay a $25.00 charge for any check returned by a bank for insufficient funds, closed account or for any other reason.

Restroom Trailer Rentals

  • Customer must provide access to a power source within 100' of the trailer location unless a generator has been added to the rental. 1 x 20-amp 110v circuit is necessary for standard trailer operations. For cold weather operations 2 x 15-amp 110v circuits are required (water heater requires an additional circuit). Standard 3-prong Edison plug outlets are fine. If customer is providing their own generator it must have a minimum of 3,500-watt/20-amp.
  • Company will provide up to 100' of hose to connect trailer to available water source on site. If the water source is greater than 100' from the trailer the customer will need to provide additional hose to cover the difference. A standard hose spigot with standard water pressure is fine. If no water source is available Company can deliver the unit with water using the onboard water tank. An additional fee may be incurred for onboard water delivery. Arrangements must be made ahead of time if water is to be delivered.
  • It is the Customer's responsibility to ensure that the property/venue has a suitable site for the trailer. The area of placement needs to have a level ground and clear of trees. Each Unit is 12ft wide when the steps are down. The 2-stall trailer is 16ft in length and the 4-stall trailer is 30ft in length. The entrance to the restrooms are on the passenger (vehicle) side of the unit when towing and this needs to be considered when deciding on a site.
  • The road into the property/location needs to be considered and must be of good condition with no excessive rocks, holes, brush, inclines, etc.
  • Customer is responsible for any and all damage to the trailer and any other rented items (ie generator) while at the location of this reservation. Total replacement value of our 2-stall trailer is $40,800 per trailer. Total replacement value of our 4-stall trailer is $72,150 per trailer.
  • Customer must monitor waste & water levels - $1,000 charge for overflow or lack of water to flush - plus damages. Customer will be able to see and smell when the holding tank is reaching the maximum level. The trailers must stop being used, locked, and Company must be notified immediately if/when this happens.
  • Company will provide the following equipment and supplies necessary for proper operation of trailer and individual restroom stalls: Toilet paper installed on wall mounts with extra rolls in storage cabinets, Paper towels for dispenser units, liquid hand soap in dispenser unit.
  • The Unit(s) shall be used for portable restroom purposes and for no other purpose. Customer is not to put the Unit(s) to any use which is illegal, creates a nuisance or causes the rate of insurance to increase.
  • No smoking is allowed in the Unit(s). If smoking occurs, there will be a $200 fee.
  • Customer agrees to close and lock all outside doors to the Unit(s) at night following each day or event of use.
  • Under no circumstance are the Unit(s) to be moved by Customer. If the units need to be moved after initial setup, Company must be notified (this can be prearranged), and if possible, will move the Unit(s) at an additional charge.
  • Company will provide all initial toilet paper, trash bags and hand towels. Customer is responsible for restocking of supplies using those supplied provided during the event unless other arrangements are made. Supplier may have extra supplies available but will not restock during the event.
  • All electrical cords and water hoses brought by Company are the property of Company and must be returned.
  • A deposit with signed contract is required to secure the reservation. This deposit is refundable (minus 4% to cover merchant processing) for reservations cancelled at least 60 days prior to the event. The balance of the reservation is to be paid no later than 30 days prior to scheduled delivery date. If other items and/or services are needed such as a generator, extra waste dumping, supplies, etc., the cost will be added at a cost dependent on the item needed.
  • Only human waste is permitted in the toilet. No garbage or toxic materials of any kind are permitted to be disposed of in the toilet.

Terms & Conditions

  • Customer will not alter or make attachments to the equipment. Customer will immediately notify Company and discontinue use of the equipment if it becomes unsafe or in disrepair.
  • Customer chooses the site for delivery and setup of the equipment and accepts all responsibility in connection with that choice of location.
  • Customer quote is based on: easy access to site, and a firm and level ground. In addition, trailers are inoperable at extreme inclines and may deem a location unacceptable or subject to additional charges.
  • Without the prior written consent from Company, the customer will not assign this Agreement or any rights or obligations hereunder and will not transfer possession or control of the equipment.
  • Customer is responsible for cost of replacement and repairs due to fire, theft, carelessness, accidental damage, vandalism or riot and agrees to return rental equipment to Company in delivered condition.
  • Company reserves the right to make equipment substitutions of equal or better quality. Company may subcontract some or all of its services when necessary.
  • If the customer fails to make any payment or fails to perform any obligation due hereunder, Company may pursue all remedies available by law or in equity, including termination of this Agreement without notice, repossession of the equipment without legal process, and recovery of all sums due hereunder. Such remedies shall be cumulative.
  • A $75 fee will be charged to the customer for each instance where a delivery and/or pickup cannot be completed on the first attempt because of lack of access to the venue (ie the gate is locked or no one is available to confirm trailer location).
  • The average setup time is 1 hour for restroom trailers. If through no fault of the driver, (i.e. the site is not ready, gate is locked, other vendors blocking access) the setup takes longer than 1.5 hours per trailer, the charge will be $100 per hour for each additional hour. Any site changes after delivery begins will be charged accordingly during set up and are payable by credit card.

Damage, Vandalism and Graffiti

These terms apply to every rental, from a one-day event to a long-term rental. Customer is responsible for all loss, theft and damage to the Unit(s) and all rented items from delivery until pickup, whatever the cause. This includes damage by Customer, employees, guests, attendees, visitors, trespassers or unknown persons, and damage from fire, weather, freezing, carelessness, accident, vandalism or riot. Normal wear from proper use is excluded.

  • Damage includes, but is not limited to: graffiti, writing, carving, stickers or paint on any surface; damage to walls, ceilings, floors, doors, partitions, trim or cabinets; damage to or theft of decor, artwork, mirrors, shelves, plants, signs or lighting; broken, removed or damaged toilets, sinks, faucets, dispensers, fans, heaters, light fixtures, locks or hardware; and fire, smoke or burn damage, including from vaping or smoking.
  • Graffiti removal: billed at actual cost based on the extent of the graffiti, with a minimum charge of $150 per stall or wall surface.
  • Wall, panel, door or floor repair: actual repair cost, $250 minimum.
  • Standing mirror replacement: $320 each. Backlit mirror replacement: $575 each.
  • Toilet replacement: $485 each. Sink replacement: $620 each.
  • Door lock or hardware replacement: $220 each. Soap, towel or paper dispenser replacement: replacement cost.
  • Stolen or damaged decor (art, plants, signs, shelves): replacement cost, $150 minimum.
  • Missing or damaged cords or hoses: replacement cost. Items not listed: actual cost of parts and materials plus labor at $100.00/hour.
  • Company photographs the Unit(s) at delivery and documents new damage with dated photos. Company's reasonable determination of repair or replacement cost, based on actual invoices or Company's current rates, is final. If damage exceeds the cost of repair, Customer pays up to the replacement value stated above.
  • Customer will report any damage, vandalism, theft, overflow, leak or malfunction to Company within 24 hours of discovery.

Service Calls

If a service call is needed because of misuse, or for any reason that is not the fault of Sitting Pretty Potties (for example, a clogged toilet), Customer will be charged a service call fee. The minimum service call fee is $300.00, which includes the trip to the site and the first hour of work. Work beyond the first hour is billed at $100.00 per hour. Any damage charges are billed in addition to the service call fee.

  • Billable service calls include, but are not limited to: clogged or overflowing toilets caused by anything other than human waste and toilet paper; waste tank overflow or a lack of water to flush because levels were not monitored; repair or cleanup after damage, misuse or vandalism; graffiti removal or cleanup beyond routine cleaning; restocking or cleaning visits Customer requests; loss of power or water caused on Customer's side; and calls for issues not caused by Company's equipment.
  • After-hours calls (weekdays after 5 p.m., weekends and holidays): $400 minimum. Unscheduled tank pump-out: $300 in addition to the service call. Parts and materials: cost plus 20%.
  • Service calls caused by normal wear or by a failure of Company's equipment that Customer did not cause are made at no charge. Company documents the cause of each service call with photos and a written note on the invoice.

Long-Term Rentals (30 Days or More)

In addition to all terms above, these terms apply to rentals of 30 days or more. Rates, the service schedule and any security deposit are stated in Customer's quote or invoice.

  • Rent is billed monthly in advance. Service call, damage and cleaning invoices are due net 30 from the invoice date. Unpaid balances more than 30 days past due accrue 1.5% per month. Customer must dispute an invoice in writing within 15 days.
  • Scheduled service visits include pumping the waste tank, refilling fresh water if the Unit is not connected to a water source, restocking toilet paper, paper towels and hand soap, routine cleaning, and a visual condition check. Between visits Customer keeps the Unit(s) reasonably clean, empties trash and refills supplies from the stock left on site. Company may adjust service frequency if usage requires it, with written notice before any rate change.
  • Company may apply any security deposit to unpaid rent, service calls, damage, cleaning or missing items. Any remaining balance is refunded within 30 days after pickup and final inspection.
  • Customer may end the rental early with 30 days' written notice, paying rent through the notice period, the pickup fee and any outstanding charges. Extensions are billed at the same monthly rate unless agreed otherwise in writing.
  • Customer will supervise use of the Unit(s), take reasonable steps to prevent vandalism and theft, and lock all exterior doors at the end of each day and whenever the Unit(s) are unsupervised.
  • Power must stay on 24 hours a day, including weekends, holidays, breaks and closures, so heat tape and heaters can run. Customer is responsible for freeze damage caused by loss of power or water on Customer's side, and will give Company 7 days' notice before any planned shutoff or closure longer than 48 hours. Winterizing and de-winterizing are billed as service calls.
  • Before delivery, Customer will provide a certificate of insurance showing general liability coverage that names Sitting Pretty Potties LLC as additional insured, or confirms coverage for rented equipment in Customer's care. Customer's insurance is primary for loss or damage to the Unit(s) during the rental.
  • Customer grants Company access to the Unit(s) during normal operating hours, and at other times with reasonable notice, for service, inspection, repair and pickup. If Customer issues a purchase order, this Agreement controls over any conflicting purchase order terms.
  • If Customer does not pay when due, Company may suspend service, terminate this Agreement with 10 days' written notice, remove the Unit(s), and recover all amounts owed, including collection costs and reasonable attorney fees.

Starting 1/1/2023 a 3.3% fee will be charged for credit card payments. To avoid this fee you can pay via ACH.
